Understanding Stamp Duty in Malaysia

What is Stamp Duty?

Stamp duty (duti setem) is a tax on legal documents related to property transfers in Malaysia. When you buy a property, you pay stamp duty on the Memorandum of Transfer (MOT) and, if you take a loan, on the loan agreement.

Foreign Buyer Rate

From January 2026, non-citizens and non-permanent residents pay a flat 8% stamp duty on residential property purchases.

First-Time Home Buyer Exemption

Malaysian citizens purchasing their first residential property priced at RM500,000 or below are eligible for 100% stamp duty exemption on both the MOT and loan agreement. This incentive has been extended until 31 December 2027.
